00:00A retired Supreme Court official has affirmed that the arrest of former President Rodrigo

00:05Duterte adhered to legal procedures. According to retired Associate Justice Antonio Carpio,

00:10the Philippine government is authorized to surrender individuals with pending cases before

00:15the International Criminal Court or ICC, citing Republic Act 9851 as the governing law in the

00:23absence of the Philippines' membership to the Rome Statute. In response to Duterte's legal counsel,

00:28Atty. Salvador Mededea, a statement on kidnapping Carpio encountered this argument,

00:34stressing that the Philippine law explicitly allows the government to surrender individuals

00:39with ICC cases. Section 17 of Republic Act 9851 provides the legal basis for such action.

00:58So that's authority of law.

01:05Of course, the person who surrenders will not agree, but that will not stop the government

01:14from exercising its authority under the law because the law says the government can surrender.
