00:00The oral arguments in the Supreme Court continued regarding PhilHealth's payment of Php 60 billion in the National Treasury.
00:08The Supreme Court's question to PhilHealth was,
00:11why did the fund return if there is a high value of the benefits that hasn't been paid yet?

00:24The Supreme Court submitted to the PhilHealth's approach to answer the question,
00:29why did PhilHealth remit Php 60 billion to the National Government if there are still debts?
00:35Associate Justice Ami Lazaro Javier answered the question.
00:40Has PhilHealth paid all the recorded and recognized claims?

00:47Before it transferred the funds to the Treasury?
00:52Your Honor, in a certain cut-off date, Your Honor, definitely not all were paid and yet you transferred the funds already.
01:07In the 2021 financial statement of PhilHealth, which was audited,
01:11PhilHealth paid Php 1.16 trillion in benefits while its asset is only Php 347 billion.
01:20This means that PhilHealth's deficit is more than Php 816 billion.
01:25According to the adverse opinion of COA,
01:28PhilHealth did not follow the correct accounting standard and it is likely that their deficit is even bigger.
01:35Financial statements do not present fairly the financial position of PhilHealth.
01:41In short, the negative equity of PhilHealth may be way more than Php 816 billion.
01:49Even if you double up your assets, they're not enough to pay off your liabilities.
01:55The deficit gradually dropped to Php 26 billion in 2022 but it's still a deficit.
02:03From these assets, the law requires PhilHealth to set aside a portion called reserve funds
02:14precisely to cover payments for the claims of beneficiaries.
02:20And that portion has to be used exclusively for the claims, to pay the claims of the beneficiaries.
02:32And if there is an excess, then additional programs should be set up.
02:38And if there is still an excess in the excess, then investment may be made.
02:47But PhilHealth said that it will not pay all the debts at the same time.
02:51It can afford to collect the direct contribution of the members.
02:55Requirement of the law, Your Honor, particularly in Section 11, reserve fund for a maximum of 2 years, Your Honor.
03:04Is the reserve funds just in paper?
03:07Are you not supposed to reserve real money?
03:11You cannot predict when people get sick.
03:15The government corporate council of PhilHealth also said that PhilHealth is not a low-carotid
03:20because this is the government's answer.
03:22It is the state insurance company.
03:25It cannot be insolvent because by law,
03:28the government of the Philippines guarantees the financial viability of the program
03:35or the national health program administered by PhilHealth.
03:40Outside the Supreme Court, petitioners asked why they are returning to the government
03:46the 60 billion pesos they received from PhilHealth.
03:49PhilHealth's funds are not enough.
03:52The government abandoned its responsibility to give subsidies to indirect contributors,
04:03to the indigent, and now it is passing it to the contributors of the workers.
04:09It is clear that PhilHealth's funds are not enough for this reserve fund.
04:15It is not enough for us to say that as long as PhilHealth has a balancing fund, it is an excess fund.
04:21Dr. Tony Leachon also filed a petition against the government and Congress
04:26for giving a zero budget to PhilHealth for 2025.
