जबलपुर हाईकोर्ट के जज जस्टिस विवेक अग्रवाल ने यह भी कहा कि एमपी के थानों में अपराध सहज तरीके से दर्ज हो जाते हैं. इसीलिए एनसीआरबी के आंकड़ों में एमपी में अपराधों की संख्या अधिक दिखती है.

00:00If we look at all three of them at the same time, then justice cannot be achieved.

00:07The work of investigation is to gather information.

00:12The work of prosecution is to present it.

00:15And the work of the court is to give justice to the information that has been collected and presented.

00:24And this subtle difference should always be kept in mind.

00:29Because the day this difference is eliminated, the last person in the society will have to face justice.

00:36And this difference can seem bitter to you somewhere.

00:41I hope that where investigation and prosecution feel very excited and try to get excited,

00:50they should be separate, they should act independently.

00:54When you get a charge sheet, you should analyze it in a subtle way.

01:01You should do the vetting and see if there are any mistakes in the investigation.

01:06There is no fraud against an innocent person.

01:15Information is being given about the right person or the right crime.

01:22Investigation is being done for many other reasons.

01:28We know that pressure is being put on the administrators of the society, on other parts of the society, and on the judiciary as well.

01:38But it is the discretion of the officer how he deals with that pressure.

01:45But there are inconsistencies in the society, there are good and bad.

01:50And I think it is a very important job of the prosecution to filter out those inconsistencies.

02:00Look, wherever the rights are given, there are duties along with the rights.

02:09And our role becomes more important.

02:12I was just looking at the statistics that are on your screen.

02:16In the case of rape against women, there was a 47% increase.

02:20In Madhya Pradesh, we can take credit for one thing.

02:24And the main credit will go to the police authorities and the district administration.

02:31That reporting is still easy here.

02:34And because reporting is easy, the records in the National Crime Bureau show that there are a lot of crimes here.

02:44But I am not interested in those statistics.

02:48In fact, I would like to give credit to both these groups.

02:52Comparatively, reporting of crime is easier here.

02:56And therefore, a common man is able to report the crime, be it under the SCST Act or any other Act, which gives a higher figure.

03:05In some other states, reporting is not so easy.

03:10But after saying this, I would like to say one more thing.

03:14We have such cases where, while abusing this Act,

03:19only to get compensation or to harass the person in front of you,

03:24false cases are filed, in which the involvement of the police seems to require the consultation and investigation of some officials like you.

03:35In a systematic manner, neither should there be an investigation nor should there be a report.

03:41And we should go into the depth of the matter.

03:44We should investigate whether the matter is true or false.

03:49Yesterday, in an appeal, we acquitted two boys after 6-7 years.

03:54It was found that the entire case was false.

03:56The person who went to jail for 6-7 years,

03:59he has become engrossed in the society.

04:01He has fallen in love with the society.

04:03And when he returns from jail,

04:06what employment will he get?

04:08And what life will he lead?

04:10And what will be his future?

04:12We need to think about this as well.
