00:00Is there a difference between a contested and uncontested divorce?

00:05Here in Canada, yes, there is a big difference.

00:09A simple divorce, you can just file it if you have nothing to do with the patrimonial property

00:19and nothing to do with the custody of the child.

00:23Although we use different terms here in Canada, we no longer use the term custody

00:29because it's highly adversarial in nature.

00:32What we call it here is decision-making responsibility at parenting time.

00:38But if you add it up, it's also custody.

00:42If the husband and wife do not agree with respect to custody, child support,

00:51spousal support, and the so-called property relations,

00:56they have nothing to do with it, they can proceed via a simple application.

01:03But once they do not agree with any of the family issues that I mentioned,

01:09that is what we call a contested divorce.

01:12And does it take a long time?

01:14It also takes a long time.

01:16The process here has a first appearance.

01:20Usually, it's just with the clerk of court, they just check the documents,

01:25they check if the other party was served properly, and then there's a settlement conference.

01:34First is the case conference and then settlement conference.

01:37The target of the courts here is as fast as possible, as much as possible,

01:46to have a resolution on the family matters of the two parties

01:52so that they can reach an agreement and negotiate.

01:56It's like a last resort.

01:59How long is the indicative time frame?

02:04The simple divorce here is usually a few months but of course if the respondent lives in the Philippines,

02:14we already know that if we serve, it will go to the Central Authority of the Philippines beyond our control.

02:23The Central Authority of the Philippines, the Supreme Court, their endorsement in RTC,

02:30they have a sheriff there who physically serves the respondent, the ex-client.

02:38Usually, the return of service comes back to us around two months, the usual timeline.

02:47And then when it comes back to us, we process it again, we call it the divorce set down.

02:54Usually, for the simple divorce application, we have the fastest way to fix it, three months.

03:00The order came out but usually, it depends on the court's docket, it can take up to eight months to a year or so.
