Justin Timberlake might have an ace in the hole to get his DWI case dismissed ... and it's a woman who took the keys to his car after his arrest ... TMZ has learned.

00:00Justin Timberlake and something we did not know about the night of his DWI arrest out on Long Island after the stop who?

00:08Came I guess you would say came to his rescue or attempted to come to his rescue

00:12And that would be one of his friends that was in the car

00:15He was following there where we knew that he had told police he was following some friends home

00:20It was a husband and wife and he was going to their house to spend the evening

00:25When he got stopped they circled back

00:28When they saw Justin got stopped and the woman got face-to-face with the cop had a very interesting conversation with

00:35the arresting officer which

00:38Very well could come into play as Justin and his lawyers as they say they're going to fight this

00:44And I have a feeling this will come into play because what we found out is that the the couple

00:51Came back and the woman who was in the in the passenger seat

00:55Walked over to the officer and had a conversation that was basically

01:00You don't want to why are you arresting Justin Timberlake?

01:03Let's yeah, that's yeah said you're going to arrest Justin Timberlake. That is a do you know who she is?

01:08That's playing the card right know who he is and we know of course the officer did not know who Justin and then she said

01:14We'll just can we just drive him home. We'll get him safely and you know forget about it

01:19but she is in his face as

01:21They're talking

01:22So he had a an eyesight and he could smell if there was something to smell the officer could as this woman is talking to

01:30Him here's the twist. So they said no, we are arresting Justin Timberlake

01:34And they took him away, but they allowed her to drive his rental car

01:40back to her to her home, so

01:44This person we found out was actually at the same hotel where Justin was before he left

01:50And as he admits he had one martini is what he told police

01:54Well the person the woman who was in that passenger seat

01:57She was at the hotel long before Justin two hours before and she was drinking

02:03so the what we're told is that

02:07Justin's lawyer at Burke jr. Is

02:10Going to raise this issue and say this woman should not have been driving a car

02:15And if the officers let her drive how good were they at evaluating

02:21Anything and it just puts their credibility into question. That's gonna be the argument

02:25It is a really clever argument

02:27I'm not sure at the end of the day it makes the difference being guilt or innocence for Justin and what it does is it

02:32Puts a lot of pressure on authorities to potentially settle the case

02:35For a lesser charge or plea down to much lesser charge any sort of drunk driving offense

02:40And that's really where Justin wants the thing to end anyways, so it really does play in their favor

02:44Yep, and there's a hearing on Friday, and I believe

02:48They are gonna raise this and other issues

02:51I doubt this case is gonna get dismissed

02:54I think Jason's right that if he can get a reckless driving out of this it's a win for Justin, right?

02:59I'm Draymore, East St. Louis, Illinois in my opinion the cops were wrong for not evaluating the friend letting her drive off

03:08She put other people lives in danger as well as her own life, and it was just a lose for the cops

03:13They didn't do their job. That's that's what Justin people are gonna say. That's the way you get a plea bargain
