I am a Filipino.
00:02
How can you say you are a true Filipino?
00:05
If you were born in the Philippines?
00:07
If you grew up here?
00:09
Or if you studied here?
00:11
You don't need to remember the name of your grade school teacher.
00:15
We don't need to remember our past.
00:18
Here's what you need to know if you are a Filipino citizen.
00:22
According to Article 4, Section 1 of our 1987 Constitution,
00:26
Filipino citizens are to be considered as followers.
00:31
Before our 1987 Constitution,
00:34
we had a 1973 Constitution
00:37
and we also had a 1935 Constitution.
00:41
Under the 1973 Constitution,
00:43
if your mother or father is a Filipino,
00:47
you are considered a Filipino.
00:49
Filipino citizens who were born to Filipino mothers
00:56
and when they reach 18 years of age,
01:00
they decided to elect Philippine citizenship.
01:03
Filipino citizens under the 1935 Constitution
01:07
are those who have a Filipino mother or father
01:10
or those who were born abroad but hold a public office.
01:15
So all of those can actually be considered as Filipino citizens
01:19
under the first category.
01:20
If an individual was born to a Filipino mother or father
01:28
or both Filipino citizens,
01:31
they are Filipino citizens.
01:32
And of course, when we talk of the term father or mother,
01:36
we are actually talking about the biological parents
01:40
or parents of the child.
01:43
Yes, that's clear.
01:45
We need biological parents.
01:48
What is the significance of January 17, 1973?
01:54
This census was actually the date
01:57
that the 1973 Constitution was adopted.
02:01
If your mother is Filipino,
02:04
she gave birth to your father, Dayuhan Banyaga.
02:08
Upon reaching 18 years of age,
02:10
you are given the choice
02:11
whether to follow the citizenship of your foreigner father
02:15
or your Filipino mother.
02:17
Before, you are only required to choose one.
02:21
But now, we have such a thing as a dual citizenship.
02:26
So, dual citizenship, as Supreme Court decisions will tell us,
02:32
is different from dual allegiance.
02:35
Only dual citizenship is allowed in the Philippines,
02:37
not dual allegiance.
02:39
Remember that even in citizenship,
02:41
we should be loyal to one another.
02:45
Naturalized Filipino citizens
02:47
are the ones who were originally born as Banyaga,
02:50
but they chose to become Filipino citizens
02:53
and they went through the process
02:56
to use Filipino citizenship.
02:58
There are two ways to obtain Filipino citizenship.
03:02
It can be by birth or it can also be by naturalization.
03:06
When we talk about natural-born Filipino citizens,
03:10
these are the individuals who were born as natural Filipino citizens.
03:16
When we talk of a naturalized Filipino citizen,
03:20
they are the citizens of other countries.
03:25
But by choice, they chose to become Filipino
03:29
and they chose to go through the process of naturalization
03:34
that we are implementing here in our country.
03:41
There are actually three ways
03:43
where a foreigner can be naturalized as a Filipino citizen.
03:50
First, there can be a law from Congress
03:53
allowing a particular foreigner to become a naturalized Filipino citizen.
03:58
Another mode is by judicial naturalization.
04:02
This means that Banyaga will file a petition for naturalization in court
04:10
and the court will issue a decision
04:13
granting the petition for naturalization as a Filipino citizen.
04:17
And the third is administrative naturalization
04:21
in accordance with Republic Act No. 9139.
04:23
That's the law for administrative naturalization.
04:27
Administrative naturalization is only available to Banyagas
04:33
who were born here in the Philippines,
04:36
who have lived here in the Philippines since birth,
04:39
who have studied here in the Philippines,
04:41
who were born here,
04:43
who were born and raised here,
04:45
and who have a job or business here.
04:48
There are two concepts used
04:50
to talk about the citizenship of a person.
04:53
This is Jus Soli and Jus Sanguinis.
04:55
In Jus Soli or Right of the Soil,
04:58
a person's citizenship is based on the place where he was born.
05:02
In the Philippines, we follow Jus Sanguinis.
05:05
Jus Sanguinis principle,
05:07
citizenship is acquired by birth,
05:10
which means that your Filipino identity
05:14
is acquired based on the nationality of your parents.
05:20
That's why when it comes to citizenship,
05:22
birth certificate is important.
05:24
This is where we can see the citizenship of a person's parents
05:28
based on their citizenship.
05:31
In our civil registry system,
05:33
when an individual is born,
05:36
his birth must be registered within 30 days
05:42
counted from the actual date he was born.
05:45
That's the usual process.
05:48
Once it exceeds the 30-day mark,
05:52
you can register your birth
05:54
through the process of late registration.
05:57
Are there consequences if the applicant is wrong
06:01
and gives his documents?
06:03
For example, if he committed a crime
06:07
that is not true,
06:10
so perjury is one,
06:12
then falsification is also possible.
06:14
These are criminal cases.
06:16
If the individual is found to be not a Filipino citizen,
06:20
that individual may lose the status of a Filipino citizen,
06:24
privileges that are only reserved for Filipino citizens,
06:28
the right to vote and be elected to a public office,
06:32
the right to own lands in the Philippines,
06:35
the right to exercise a profession.
06:37
Now we know how to avoid revoking our Filipino citizen card.
06:41
Remember, even if we don't remember our childhood,
06:45
what's important is that our identity is officially and registered.
