00:00:12 here today, Dr. Murphy. This week he announced that he was diagnosed with a
00:00:18 base of skull tumor. All of us on this committee know that Dr. Murphy is a
00:00:24 fighter. I think I speak for everyone when I say we're all keeping Dr. Murphy
00:00:28 in our thoughts and prayers. We wish him a speedy recovery and are looking
00:00:32 forward to him being back on this dais with us again soon. Knowing Dr. Murphy, I'm
00:00:38 guessing he's probably watching the live feed from home and so if you are Dr.
00:00:41 Murphy we look forward to having you back. Today we will consider legislation
00:00:46 to stop foreign influence in our elections, prevent non-citizens voting,
00:00:50 and strengthen our election administration. Over the past several
00:00:54 months this committee has examined different pieces of legislation that
00:00:58 would increase confidence in our elections. When Americans are more
00:01:02 confident in their that their elections are secure, they're more likely to
00:01:07 participate. As chairman of the committee, my focus has been on increasing
00:01:12 confidence in participation in our elections. Last week we held a hearing
00:01:18 focused on non-citizen voting and foreign influence in our elections.
00:01:22 Witnesses discussed the difficulties the National Voter Registration Act can place
00:01:27 on states and the challenges states have at maintaining clean voter rolls. We've
00:01:32 also demonstrated how foreign nationals are trying to influence our elections
00:01:37 here in the United States. Federal law prohibits foreign nationals from
00:01:41 contributing to campaigns, yet we continue to see foreign nationals use
00:01:46 loopholes to get around this. We'll consider legislation today to address
00:01:51 this issue. My legislation, the Preventing Foreign Interference in
00:01:55 American Elections Act, would close the loophole and strengthen donor privacy
00:02:00 protections. We'll also consider legislation to help states clean their
00:02:03 voter rolls and prevent non-citizens from voting. Non-citizen voting in our
00:02:11 elections must be stopped. You may hear my colleagues say, my colleagues on the
00:02:17 left say, non-citizen voting in federal elections is already illegal. But as we
00:02:23 discussed in last week's hearing, there have been non-citizens registered to
00:02:27 vote in Ohio, in Virginia, in Pennsylvania. Here in our nation's capital, the DC City
00:02:34 Council passed legislations to allow non-citizens to vote in municipal
00:02:38 elections. And non-citizens will be voting this fall. The DC Board of
00:02:44 Elections recently confirmed that nearly 500 non-citizens have registered to vote
00:02:51 in our nation's capital, and that number is only growing. Early voting for DC's
00:02:56 primary election is happening right now. And as we sit here today, non-citizens
00:03:01 are voting to elect members of the DC City Council. That's absurd. We must do
00:03:07 two things. One, we cannot allow DC citizens vote, the DC citizens voting law
00:03:13 to spread across the United States. And two, we need to ensure non-citizens
00:03:19 aren't voting in federal elections across the United States. While it's
00:03:24 illegal today for non-citizens to vote in our federal elections, it's also
00:03:28 illegal to evade Border Patrol and unlawfully enter the country. And as
00:03:34 we've seen, that hasn't stopped anyone. We must end non-citizen voting now. It's
00:03:41 critical that we provide states the tools they need to verify citizenship
00:03:45 for individuals registering to vote. As we discussed last week in this committee,
00:03:49 it's difficult for states to maintain clean voter rolls. Last week we found in
00:03:55 Ohio, 137 citizens, non-citizens were on the voter rolls. In May of 2023, Virginia
00:04:02 removed 1,481 non-citizens from their voter rolls. Across the country, Democrat
00:04:09 jurisdictions are allowing non-citizens to vote in their elections. This will
00:04:14 continue to create challenges for states to maintain clean voter rolls unless we
00:04:18 stop non-citizen voting. The Constitution and federal law only protects the rights
00:04:23 of citizens of the United States to vote in US elections. That's why only US
00:04:29 citizens should be voting in US elections. I look forward to a thoughtful
00:04:33 discussion on the legislation before us today, and I yield back. I'll now
00:04:38 recognize the Ranking Member, Mr. Morelle, for five minutes for the purpose of
00:04:41 offering his opening statement. Thank you, Mr. Chair, and first and most
00:04:46 importantly, let me join with you in wishing our friend and colleague, Dr.
00:04:51 Murphy, a full and speedy recovery, and we're keeping him very much and his
00:04:56 family very much in our prayer, so best to him. As it relates to the hearing that
00:05:01 we held last week, which in my view was not only a waste of this committee's
00:05:06 time, but a waste of the taxpayer resources that this committee has
00:05:11 expended to disseminate the disproven lies to actively undermine American
00:05:16 faith in our democracy, and I appreciate my colleague who talks about confidence
00:05:20 in American elections and the importance of Americans having confidence.
00:05:24 Unfortunately, everything this committee has sought to do, everything the former
00:05:28 President seeks to do, is undermine that very faith. I know that every one of my
00:05:35 majority colleagues understands that this narrative will aggravate the
00:05:38 perilous infection of election denialism that is spreading in the American civic
00:05:43 body, and the rest of us know it too. Just a point about last week's hearing, the
00:05:48 Associated Press, in an article that ran in the Wisconsin State Journal this past
00:05:51 Tuesday, said, and I quote, "Republicans who have been vocal about voting by those
00:05:56 who are not citizens have demurred when asked for evidence that it's a problem."
00:06:00 USA Today, one of the largest circulations of the country, so many
00:06:04 Americans are reading USA Today, said that the SAVE Act is the same, quote, "rigged
00:06:09 election disinformation" that Trump has been hawking for almost eight years. The
00:06:14 Washington Post said that Republicans, quote, "feel compelled to construct a
00:06:17 boogeyman to tow Trump's line on combating voter fraud, even as they
00:06:21 freely acknowledge they can't say what the boogeyman is made of," end quote. The
00:06:26 deluge of articles published in the last two weeks alone shows what a transparent
00:06:30 game people are playing. The American people see through this as well. Election
00:06:36 denialism was unpopular in 2020. It was equally unpopular, if not more so, in
00:06:41 2022. It will be unpopular this November. Just as the Speaker's trip, paying homage
00:06:48 at Mar-a-Lago, tarnished our American tradition of democracy, just as the
00:06:53 Speaker's conspiracy-fueled press conference on the steps of this Capitol
00:06:57 fanned the flames of extremism, and just as our hearing energized efforts to
00:07:02 undermine American confidence in elections, this markup today is the
00:07:06 latest blemish on the majority's anti-democracy quest. We've been here
00:07:11 before. Former President Trump is leading this party, strikingly leading this
00:07:16 very committee down a terribly dangerous and un-American path. This is a man who
00:07:20 yearns for, according to his own campaign materials, a unified Reich in this
00:07:25 country. This is the man you have chained your electoral prospects, to say nothing
00:07:30 of your moral leadership and historic legacies, to. Aren't you embarrassed? I, for
00:07:34 one, am embarrassed for you. Today's markup of the SAVE Act is a repugnant
00:07:39 use of our time. Committee Democrats have grave concern about each of the bills,
00:07:43 and we will offer several amendments in an effort to make these bills better, or
00:07:46 at the very least, to offer Americans an alternative vision of democracy, one
00:07:51 based in fairness, in justice, not based on fear, cynicism, and doubt. Our vision of
00:07:57 democracy is based on a Constitution that has moved ever forward from our
00:08:02 founding, expanding its wings of equality and enfranchisement to
00:08:06 informally enslaved people, to women, to native people, to young people. That's the
00:08:11 story of this nation, one of a democracy that grows more inclusive, that ensures
00:08:15 that the voices of every American can be heard by those of us who have been
00:08:19 entrusted to walk the halls of Congress. The SAVE Act is the opposite of that. It
00:08:24 is contrary to the American story that has been told for 247 years, and God
00:08:29 willing, will be told for countless years to come. This is the fundamental
00:08:33 difference between our parties today, and the Democrats on this committee
00:08:37 will not stop fighting for the rule of law, for the peaceful transfer of power,
00:08:41 and for the very survival of this Republic. And what Committee Democrats
00:08:45 won't do is subvert American faith in elections, in an effort to supplicate to
00:08:50 a proven con man. We'll leave that to our Republican colleagues. With that, I yield back.

00:09:02 substantive copy of the measures to be considered today have been made
00:09:06 available to members and the public at least 24 hours in advance. I now call up
00:09:10 H.R. 8399, the Preventing Foreign Interference in American Elections Act.
00:09:15 As I mentioned in my opening remarks, this legislation would close the
00:09:19 loopholes foreign nationals can use to donate to campaigns. Today, under current
00:09:24 law, foreign nationals can pay for activities like voter registration, ballot
00:09:28 harvesting, and get out the vote activities. In recent years, we've seen
00:09:33 the impact that Zuckerbucks have had in reducing confidence in elections
00:09:37 administration. Our hearing last week demonstrated that foreign nationals are
00:09:42 using nonprofits as a pass-through to contribute to campaigns, often Democratic
00:09:48 super PACs. When we had the Federal Elections Commission before our
00:09:51 committee, both Democrat and Republican commissioners agreed that we must close
00:09:57 this loophole. Congress must close the loophole. We must pass this bill in order
00:10:02 to do so. I'll now recognize the Ranking Member, Mr. Morelli, if he'd like to give
00:10:06 a statement on the bill.
00:10:07 [Mr. Morelli] Thank you, Mr. Chair. I would. I fervently believe Congress has a
00:10:11 duty to stem the tide of foreign money in our elections. For this reason, I've
00:10:16 been proud to advocate for the passage of the Freedom to Vote Act, which
00:10:20 contains several provisions aimed at stemming this tide, including the Disclose
00:10:25 Act and the Honest Ads Act. I was also happy to support the majority's efforts
00:10:29 last Congress to advance a bipartisan recommendation of the FEC related to
00:10:34 foreign money and ballot initiatives. This bill seems incongruous, however, with
00:10:38 that critical duty. This bill does absolutely nothing to get foreign money out
00:10:42 of our politics. On the one hand, the measure suggests it's important to ensure
00:10:46 that foreign money does not influence American elections. Fine. On the other
00:10:50 hand, however, several provisions of this bill make it more likely that foreign
00:10:55 donors would be able to fund election activities in the United States by
00:10:58 hampering disclosure and the FEC's law enforcement capacity. We know this to be
00:11:03 true. Americans are frustrated by a campaign finance system that seems to be
00:11:08 stacked in favor of special interests and dark money donors. We know that
00:11:12 robust transparency is the best way to reassure the American people that their
00:11:16 political system works for them. As Justice Louis Brandeis famously stated,
00:11:20 "Sunlight is the best disinfectant." So why in the world would this committee's
00:11:23 majority propose legislation that undermines transparency, inviting even
00:11:28 more undisclosed dark, likely foreign money to infiltrate our political system
00:11:32 as this bill, as drafted, would do? Why in the world would the majority hamstring
00:11:37 law enforcement's ability to ensure the rule of law, to see to it that our
00:11:40 federal campaign finance laws are fairly enforced as this bill, as drafted, would
00:11:45 do? If there are drafting errors, and I hope there are, I'd ask the chair to
00:11:49 reconsider bringing this bill to a vote today. I recognize the bill includes some
00:11:53 exemptions for the donor shielding provisions. The exceptions, however, do not
00:11:58 salvage the bill. Instead, they gloss over systemic issues that need to be solved.
00:12:03 In 2017, the Trump administration reversed a years-long rule requiring
00:12:08 certain 501(c) organizations to report major donors to the IRS. Since then, the
00:12:14 dark money ecosystem has hobbled the IRS. Moreover, millions in dark money goes
00:12:21 unreported to the FEC due to loopholes unsolved by this measure. Finally, a
00:12:26 dysfunctional FEC has ceased all meaningful enforcement of existing laws.
00:12:30 Indeed, the FEC has informed this committee that it had acted on barely
00:12:33 half of the nonpartisan staff's recommended foreign interference
00:12:37 investigations, including none that involved Mr. Trump's, his campaign, or his
00:12:43 associates. In matters requiring dark money groups to register a report with
00:12:47 the FEC, the FEC acted on only five of nonpartisan career staff's two dozen
00:12:54 recommendations. I want to be clear. I'd be eager to work in tandem with you to
00:12:58 find common ground and common accord to fulfill our important duty. And I would
00:13:03 be happy to work with you to find bipartisan consensus here. In that vein, I
00:13:07 will propose several amendments today to ensure that we're able to
00:13:09 comprehensively stop foreign money infiltrating our elections. I hope my
00:13:14 colleagues join me in supporting them. If, however, the bill is designed to
00:13:18 further open the floodgates to undisclosed foreign donations, to kneecap
00:13:22 the FEC and other law enforcement agencies, then we will strenuously
00:13:25 oppose. So, Mr. Chair, you can tell me whether we work together to limit foreign
00:13:30 money or whether the majority intentionally drafted this measure in
00:13:33 such a way to make it even easier for foreign donors to hide the sources of
00:13:37 their contribution. And with that, I'll yield back. The gentleman yields back. The

00:16:38 This amendment, which is the Disclose Act, is about making sure that the
00:16:43 American people have transparency around the foreign and big money spenders that
00:16:47 have such a significant impact on our electoral system. Voters should be able
00:16:51 to follow the money. Critically, Congress should close loopholes allowing
00:16:56 spending by foreign nationals in domestic elections. For example, in 2021, the
00:17:01 Federal Election Commission, the independent Federal agency charged with
00:17:04 protecting the integrity of the Federal campaign finance process, found reason
00:17:08 to believe and conciliated a matter where an experienced political consultant
00:17:13 knowingly and willfully violated Federal law. The consultant had solicited a
00:17:17 contribution from a foreign national by offering to transmit a $2 million
00:17:22 contribution to a super PAC through his company and two 501(c)(4)
00:17:27 organizations to conceal the origin of the funds. This scheme was only unveiled
00:17:32 after a news article reported the solicitation. The same political consultant
00:17:36 was later convicted of a near-identical scheme involving a Russian national.
00:17:41 Congress must do more to stem the tide of foreign money seeking to influence
00:17:44 our elections. The DISCLOSE Act clarifies the scope of the foreign nationals
00:17:47 ban and incorporates the bipartisan FEC recommendation to capture ballot
00:17:52 initiatives among other reforms. The DISCLOSE Act also addresses the problem
00:17:56 of money that is laundered through various front groups or shell entities to
00:18:01 hide the original source of campaign-related spending. The Supreme Court
00:18:05 has repeatedly endorsed disclosure because it helps voters hold elected
00:18:09 leaders accountable. So this is a common-sense amendment that would increase
00:18:13 transparency in American democracy and stop foreign interference, something
00:18:17 that should have bipartisan support. And I urge my colleagues to support this
00:18:21 amendment. Thank you.

00:25:48 This amendment would add a prohibition to this bill to prevent foreign donors from promoting,
00:25:53 supporting, attacking, or opposing the nomination of Senate confirmation of an individual who
00:26:00 is under consideration for a federal judgeship. At a time when Americans are rightfully concerned
00:26:06 about malign donor influence in the federal judiciary, including on the United States
00:26:10 Supreme Court, this amendment will reassure Americans that foreign donors will not be
00:26:15 able to influence our courts. Several high-profile investigations have, in recent months, revealed
00:26:21 deeply concerning relationships between Supreme Court justices and Republican mega-donors.
00:26:26 Indeed, whether it has been the brazen financial dealings between Clarence Thomas and billionaire
00:26:32 Harlan Crow, or Justice Samuel Alito's astonishingly bad judgment in flying an upside-down American
00:26:39 flag, a discredited symbol of extremism and election denialism, outside of his home in
00:26:45 the days following the January 6th attack on this Capitol, the American people are in
00:26:51 disbelief about the state of our judiciary. Just last night, public reporting confirmed
00:26:56 that Justice Alito has been flying another flag associated with Donald Trump's attempt
00:27:01 to steal the 2020 election, the "Appeal to Heaven" flag, outside of his vacation home.
00:27:08 This was a flag that rioters carried as they stormed the United States Capitol on January
00:27:12 6th. Polls have shown that these ethical lapses have deeply hurt Americans' faith in the fairness
00:27:19 of our judiciary. Americans should not have to worry that foreign donors, in addition
00:27:24 to extremists and conservative activists, are influence-peddling on our Nation's highest
00:27:28 court. This amendment should have bipartisan support. I urge my colleagues to vote yes,
00:27:33 and I also ask unanimous consent to enter into the record this picture of the upside-down
00:27:37 American flag, the symbol of "Stop the Steal" extremism and the insurrectionist "Appeal
00:27:43 to Heaven" flag, both of which flew outside the homes of Justice Samuel Alito. Thank you.

00:28:52 we could definitely look in particular as it relates to the confirmation process in
00:28:56 foreign money and foreign interference, would love to work with my colleague on that. The
00:29:01 underlying legislation we have before us is focused in on elections, and so I won't go
00:29:06 through a germane process and remove the bill on germane. I'm happy to vote it up or down.
00:29:11 But I think at its core, it's not germane in the sense of what we're trying to go after
00:29:17 here in the underlying legislation, which is to remove foreign interference in U.S.
00:29:22 elections.
00:29:23 So I think it's a worthy conversation to have, the gentleman brings up, as it relates to
00:29:28 Senate confirmations and any potential foreign interference in that space. I would enjoy
00:29:33 having a dialogue and work with my colleague to find common ground in that space. It's
00:29:39 just not the purpose of the underlying legislation, which is to address foreign interference in
00:29:44 U.S. elections.
00:29:45 Further, this amendment, as the previous amendment, strikes key donor privacy protections that
00:29:50 I think are absolutely essential to maintain our First Amendment rights and to maintain
00:29:57 the integrity of the broader electoral system. And so I encourage my colleagues to not support
