00:00 Let's talk about the difficult issue of abortion.

00:02 And to know what the path forward is, you have to know the path that got us here.

00:05 I'm going to go very quickly through some constitutional history here.

00:09 Roe versus Wade was an incorrectly decided case where the Supreme Court read something

00:14 into the 14th Amendment that wasn't there.

00:17 The 14th Amendment, among other things, ensures due process under the law.

00:21 Well, that's about a procedural protection regardless of race or otherwise.

00:26 If the Supreme Court says, "We're going to read that due process clause to somehow invent

00:31 a right to privacy," that doesn't exist under the Constitution.

00:34 Now, if you wanted to really make that interpretation, I would have at least made the argument for

00:38 the Citizens'—for the Privileges and Immunities Clause for citizens to say that there are

00:42 at least certain privileges and immunities that the government gives you.

00:45 If you really want to torture a reading of a right to privacy that protects abortion,

00:49 you might have at least used Section 1 of the 14th Amendment, the Privileges and Immunities

00:52 Clause.

00:53 Nope, they didn't want to do that in the Supreme Court because of some long historical

00:57 reasons related to the slaughterhouse cases.

00:58 That's a longer history and a topic for another day.

01:01 They went to the tortured interpretation of the substantive due process interpretation

01:06 of the due process clause in the 14th Amendment.

01:09 So they basically made it up.

01:11 So what happened then about 50 years later in the Dobbs case last year was the Supreme

01:16 Court overturned Roe correctly on constitutional grounds, not on the grounds of whether they

01:21 like abortion or not, and that's what we need to understand, on the grounds of the

01:24 Constitution of the United States, making the simple holding that the due process clause

01:30 of the Constitution does not protect some unwritten right to privacy that includes the

01:35 right to get an abortion.

01:37 That's what the Supreme Court held last year and correctly so.

01:40 Great.

01:41 That's a win for the Constitution.

01:43 But now Republicans, I worry, are about to score an own goal.

01:47 Look at every candidate in this race.

01:49 Every other candidate who's on that debate stage was favoring some kind of federal ban.

01:53 Even Nikki Haley, who really refuses to make her stance clear, when pressed, says that

01:58 she would sign into law a federal abortion ban while offering a lot of mealy-mouthed

02:02 atmospherics about nice-sounding statements that refuse to take a stand on the issue when

02:07 she's forced to take some semblance of a stand, even says that she would favor a federal

02:11 ban.

02:12 Let's go to the constitutional basis.

02:15 The federal government does not have the constitutional authority to write a ban when the federal

02:20 government doesn't give them, when the Constitution does not give the federal government that

02:23 power.

02:25 What do they say?

02:26 The Commerce Clause.

02:27 Well, any Republican who's going to use the Commerce Clause to expand the federal government's

02:31 role should not be in office, period.

02:33 What do they say?

02:34 The 14th Amendment protects life.

02:36 Well, that's a more tortured interpretation of the 14th Amendment than the Roe versus

02:40 Wade court brought to bear because that was never used for the basis for the federal government

02:44 to pass murder laws or anything else either.

02:47 So we have to stick to those constitutional principles.

02:50 This is an issue for the states.

02:52 And I want to mark my words on this one.

02:55 More unborn babies will die in the next 30 years if we federalize this issue because

03:01 the next time Democrats then gain control of the White House and Congress, they're going

03:05 to say that if this is a federal issue, they can then use that to legislate Roe versus

03:10 Wade into law.

03:11 That's a loss for the pro-life movement that I consider myself to be part of as well.

03:16 So what's the right answer?

03:18 States need to take action.

03:19 And how do we do this in a way that doesn't compromise on our pro-life principles, but

03:25 also allows us to win this next general election in a landslide?

03:30 Here's the answer.

03:32 Here's the punchline that nobody else is talking about.

03:36 We have allowed the left to define this issue as a men's versus women's rights issue.

03:43 It need not be that way.

03:44 Here's how.

03:46 Greater sexual responsibility for men codified in the law.

03:52 Speaking as a man, here's what I favor.

03:55 Laws that say if a woman brings a child to term, then she at her exclusive option in

04:03 right can make the man under the law, the principal caretaker who's responsible for

04:09 bringing up that child.

04:11 We couldn't do this in most of our nation's history, but we can today because we have

04:15 genetic paternity tests that are 100% reliable.

04:20 If we're willing to do that, now a lot of men would say, wait, hold on.

04:23 I'm not sure I'm ready for that.

04:24 That's the point.

04:25 It's not necessarily comfortable for most men, but that's exactly what we need to stand

04:29 for life, to say that it's not about men's rights or women's rights anymore.

04:33 It's about human rights.

04:34 I, for one, am ready to walk the walk when it comes to being pro-life.

04:39 If a woman brings that child to term, if she bears the pregnancy, she can then make the

04:42 man responsible for actually raising that child.

04:46 Now we're in this together.

04:48 This doesn't have to be a losing issue for Republicans.

04:50 With that simple plank, and I want to make that part of the Republican Party's pro-life

04:54 plank, part of our pro-life policy platform.

04:57 If we do that, then this isn't going to be a losing issue for us.

05:00 I think this will be an issue where we're able to stand for life, stand for what Clarence

05:04 Thomas said in that Dobbs case.

05:07 That pregnant woman who's walking the street, and if her unborn child dies as a result of

05:12 an assault, then that criminal should be held responsible for that death.

05:16 Most Americans agree on that.

05:18 And we give them the permission to say so if we codify into the law sexual responsibility

05:24 for men.

05:26 That's how Republicans win on this issue.

05:28 There's not a single other Republican talking about it.

05:30 If we make that the core of our pro-life platform, then we're going to be successful in making

05:35 sure that abortion isn't some losing issue for us, but actually an issue where we're

05:39 able to stand for our principles and still win elections as a consequence.

05:44 That's the answer on abortion.
