Let’s continue our conversation about the Federal Court’s move to rule as invalid a section of Selangor’s Syariah Criminal Offences Enactment, which criminalises sexual intercourse against the order of nature. What this means is that the Courts have concluded that under the Constitution, it is Parliament that has primacy over criminal law.
