This is the Fifth part out of Ten, of my video series on the Domestic Violence Act. In this video, I will try to explain and interpret in layman words the following six questions came up for the consideration before the Hon’ble High court.
(1) Whether a wife who has been living separately from husband prior to the Act came into operation is entitled to claim reliefs after its enforcement?
(2) Whether provisions of S. 468 of Cr.PC are applicable upon the proceedings initiated under the DV Act?
(3) Maintainability of Proceedings initiated u/S. 27 of DV Act i.e. territorial jurisdiction of the Court?
(4) Can proceedings u/S. 2 Of DV Act be filed against female members of husband's family?
(5) Applicability of DV Act against husband when he does not live in India?
(6) How to execute the order of the Family Court in a foreign country? and how does Chp - VII-A of Cr.PC applicable to this Act?
