If mediation is unsuccessful, the mediator will declare an impasse, and the lawsuit will continue on a track toward a resolution imposed by a trial court rather than by agreement of the parties. This resolution may take the form of a verdict issued after trial in front of a judge or a jury, or an order by a judge granting a motion for summary judgment or other case dispositive relief. Even where mediation is unsuccessful, however, the parties continue to have the ability to settle their case by direct negotiation before, during or after a trial, and often do so.
