HC order on frozen baba draws Dera counsel ire

The counsel of Jalandhar-based Divya Jyoti Jagriti Sansthan (DJJS) has said the Punjab and Haryana High Court has no powers to declare a person dead and that ordering someone's cremation is also beyond the jurisdiction of any court of law.

"We are trying to convince the court that the December 1 judgement is against the law. The court cannot go into the question whether someone is in samadhi (meditation) or how he will be cremated. All issues were wrongly decided by the single bench," advocate Satya Pal Jain said.

The high court on Thursday adjourned the hearing in the Ashutosh Maharaj case till Monday. The court also decided to club all three appeals - by Dilip Jha, Divya Jyoti Jagriti Sansthan and the Punjab government - filed against its December 1 ruling in which the single bench had directed the state government to cremate the dead seer within 15 days.

The baba's body has been kept in a freezer since January this year with his followers refusing to cremate him saying that he is not dead but merely meditating. The dera's counsel also trashed the claim of Dilip Kumar Jha that he is Ashutosh Maharaj's son and said all the documents he produced in favour of his claim were forged.
