Rizwan Siddiqui's wife moved an application in Bombay High Court over his arrest calling it illegal as the notice under section 41A CRPC not served before arresting him. On Wednesday, the court was convinced that the Thane cops have not followed the legal procedure. The prosecution has said, notices served to him but he didn't accept. But in the punchama of Thane cops section, 41A notices not mentioned. Court has asked Thane cops to release him or shall we pass the order? Cops have sought time for two hours. Hearing adjourned till 1 PM.
