The Weinstein Company Places ‘All’ The Blame On Harvey In Latest Court Filing

The Weinstein Company wants out of the class-action suit filed against them by six Harvey accusers last year – and a major reason is because the studio has shifted all of the blame on Harvey himself.
On Dec. 6, 2017, six women filed the class action lawsuit against TWC, Harvey, Miramax Film, and others, alleging all defendants were involved in racketeering and operating an immoral organization dubbed the “Weinstein Sexual Enterprise.”
Now, RadarOnline.com has uncovered the shocking documents where Harvey’s former company takes no responsibility for his alleged inappropriate behavior.

“Virtually all of the alleged conduct about which Plaintiffs complain in the Complaint was committed by H. Weinstein, acting alone, between ten and twenty-five years ago,” the docs state.
The company also alleges in the filing that the statute of limitations for all claims against TWC have expired.
“Plaintiffs’ own pleading on its face shows that the claims are all based on conduct that occurred a decade or more ago, and therefore the limitation periods for all of the Plaintiffs claims expired years ago,” TWC states in the court docs.

TWC claims all alleged actions resulting in emotional distress for the plaintiffs were Harvey’s fault.
“The individual claims of civil battery, assault, and negligent and intentional infliction of emotional distress against TWC are all based on conduct allegedly committed by H. Weinstein,” the documents state.
Harvey’s former company also states the plaintiffs fail to explain “how TWC benefitted or could have benefitted from H. Weinstein’s alleged behavior,” according to the documents.
TWC also chalks up the alleged acts as “one-time unwelcome incidents committed by H. Weinstein completely unconnected to any sex trafficking scheme.”

In the filing, TWC also claims the plaintiffs “do not identify any purported actions by TWC that they allege caused them injury or will likely cause them future injury.”
TWC also adds that “four plaintiffs bring claims arising from conduct before September 2005, before TWC existed as a legal entity.”
