N.Y. restaurateur accused of hitting man so hard he has brain damage

NEW YORK — A Manhattan restaurateur is accused of drunkenly punching another man so hard he left him brain dead.

Dard Coaxum — the former co-owner of the posh French bistro Cedric and a current partner in the popular eatery Harlem Shake — was in court Jan. 28 facing misdemeanor charges for a late night brawl that occurred on June 26, 2015.

According to the New York Post, the 46-year-old restaurateur, who calls himself Harlem Gastby, had found a credit card on the floor of Suite 308, a club that has since been closed, during a night of partying.

When Coaxum returned the card to Julio Torres, 43, he demanded a drink for his good deed, according to prosecutor Joshua Steinglass. Torres did not oblige.

The two ended up at Gourmet Deli by chance early the next morning, where surveillance video from inside the shop showed Torres offering to share a bag of chips with Coaxum. The pair get in an intense discussion when Coaxum's girlfriend interferes and takes over the conversation with Torres.

After a few minutes, Coaxum returned and faced Torres, who continued to talk and gesture towards him. Coaxum then suckerpunched Torres causing him to fall over. But Torres got back up and continued the conversation. At one point, a man in a black suit said something to Torres that caused him to leave the deli. Off camera, prosecutors said Torres continued to taunt Coaxum and his friends. That is when Coaxum allegedly kicked him head-first to the ground.

"[Torres] toppled over like a tree that had been chopped down, cracking his head on the pavement," the prosecutor told the panel of eight jurors last week before Judge Ann Scherzer, according to the New York Post.

According to court records, the incident occurred at 3:54 a.m. Coaxum was arrested July 1, 2015 for the incident.

Torres is said to have suffered severe brain damage leaving him unresponsive. Coaxum faces up to a year in jail.

His next court date is slated for Feb. 2.
