Chest camera video captures cop shooting, killing motorist wielding BB gun

Suicide by cop: A police body cam video which shows the shooting death of a 64-year-old Akron, Ohio resident at the hands of a University of Akron police officer after a traffic stop has been made public. Summit County Prosecutor determined that police officer involved was justified in the shooting on May 16 last year.

It was May 16. Noticing plates on a Pontiac Sunfire registered to a different vehicle, fifteen-year veteran officer Aaron Burnette pulled over James Genda. After giving Burnette a false social security number Genda told Burnette "I hate to have to do all this," and produced a weapon. Fearing for his life, Burnette responded with deadly force, firing a total of 16 bullets into Genda's vehicle.

Genda was unarmed. Burnette believed the man had just drawn a .45 calibre handgun. The weapon turned out to be a BB gun; a harmless replica.

Better dead than back in prison. Genda wanted to be shot dead were he ever to be arrested again, according to his aunt, Beth Pearson. She told investigators her nephew had told to family members that he was never going back to jail, and if he got pulled over, he would force police to shoot him.

Summit County Prosecutor Sherri Bevan Walsh judged that Burnette "had no choice but to shoot" after Genda pointed the pellet gun. No charges were filed against him.
