Virginia's Manassas City Police have stirred up a hornet's nest after taking pictures of a 17-year-old boy's penis to investigate a child porn case.
According to various reports, high school student Trey Simms of Manassas City was dating a 15-year-old girl until this January. Reports say the girl had allegedly sent him nude pictures of herself. However, the girl's mother called the police after the boy sent her daughter lewd videos of himself despite "repeatedly being told to stop."
After having charges brought against him, Simms' case was dismissed in June as prosecutors had forgotten to certify that he was a minor. However, his case was reopened in July with new charges concerning the manufacture and distribution of child pornography. If found guilty, Simms could face time behind bars, and be listed as a sex offender for the rest of his life.
The boy was arrested and jailed last week and forced to have pictures of his flaccid penis taken by the police.
Simms' attorney, Jessica Harbeson Foster, told reporters that after the photoshoot, Assistant Commonwealth Attorney Claiborne Richardson told her if her client did not plead guilty to the charges, they will acquire photos of his erect penis and "use special software to compare pictures of this penis to this penis."
Foster added that Richardson plans to do this by just taking Simms "down to the hospital, give him a shot and then take the pictures that we need."
Simms has refused to plead guilty. Police later received a court warrant to acquire the pictures of his erection. Foster has stalled the erection photoshoot by filing a motion to allow Simms to leave town to visit family. However, the teen is due back in court on July 15, when he could face the forceful photoshoot and possible jail senten
