Nizzear Rodriguez, 13, was mistakenly shot to death in his bed on Sunday morning, just few hours after his birthday celebration.

Rodriguez was said having birthday celebration at Applebee’s by neighbors. They heard gunshot between 1 a.m. and 3 a.m., which is believed when Rodriguez was killed. His death was discovered in the afternoon by his uncle.

The suspect, Malik Davis, 17, turned himself into Corroll County Police on Monday.

Investigators said they were told that Davis was seen wielding his gun looking for someone around the area couple hours before the shooting. However Rodriguez is believed the wrong target.

Davis is charged with murder, burglary and possession of a firearm.

The investigation is ongoing with the second suspect.
