Not all Santas can be perfect.

A worker at the Hanover Mall in Massachusetts may have taken a page right out of Bad Santa’s book. 62-year-old Herbert G. Jones, who was a seasonal employee for a photo company contracted to work at the mall, was accused of groping his female elf assistant.

Jones was arrested on a recent Saturday evening, after the woman came forward and filed a complaint against the fake Santa. Both the victim and the suspect were employed by a New Jersey based business called Cherry Hill Photo that specializes in holiday portraits.

According to local police “A spokesperson for Cherry Hill Photo has informed us that a comprehensive background report had been completed on the individual portraying Santa. The report indicates that he is clear of any prior arrests or convictions.”

According to the woman, Jones pinched her buttocks while they were working. She reportedly told their manager and Jones denied everything.

When the boss was questioned, he claimed the female had been unhappy on the day of the alleged incident, because she was questioned about missing money. Jones is due back in court on Christmas Eve. Due to the pending charges, he will not be able to portray Santa this holiday season.
